Andhra pradesh High Court on Friday Quashed State Govt’s Ordinance issued for State Election Commissioner Nimmagadda Ramesh Kumar’s Removal Earlier.
The High Court Orders to Continue Ramesh Kumar in his previous position as State Election Commissioner. And quashes state govt’s earlier orders issued for his removal.
Honorable High Court Says that the Ordinance Issued by the State Govt is not according to the Article 211 of the Constitution. Which Suggests not to remove state election commissioner by changing his service rules abruptly.
The High Court ruled that the state government did not have the authority to curtail the tenure of the SEC.
After High Court Judgement, SEC Nimmagadda Ramesh issued a Press Note. it says ” After the Hon’ble High Court has reinstated me , I have resumed charge . I will discharge my duties fairly and impartially as I did in the past and as mandated. In consultation with the principal stake holders and all the political parties , I wish to resume electoral process to the local bodies at the earliest on return of normalcy ! Individuals are not permanent . But constitutional institutions and the values they represent alone are permanent in the end . Those who have taken an oath of office to protect constitution , have a greater responsibility to continue to protect and safeguard these institutions and their integrity.”, SEC added.
